ImgOcean provides image hosting and sharing services. We allow users to upload, store, share, and manage images through our platform.

3. Account Registration

3.1 Eligibility

You must be at least 13 years old to use this Service. By registering, you represent that you meet this age requirement.

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account

• Contains viruses, malware, or other harmful code
• Depicts minors in sexual or suggestive contexts
• Contains graphic violence or promotes violence
• Constitutes spam, advertising, or commercial solicitation (without permission)
• Violates any applicable local, state, national, or international law

4.3 Prohibited Activities

You may NOT:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without permission
• Impersonate any person or entity
• Collect information about other users without consent
• Upload content you don't have the right to upload
• Hotlink images excessively to cause unreasonable bandwidth usage

5. Intellectual Property

5.1 Your Content

You retain all ownership rights to content you upload ("Your Content"). By uploading content, you represent and warrant that:

• You own all rights to Your Content, or have obtained all necessary permissions
• Your Content does not infringe any third-party intellectual property rights
• You have the legal right to grant the licenses described in these Terms

By uploading content, you grant ImgOcean:

• A worldwide, non-exclusive, royalty-free license to store, display, and distribute Your Content
• The right to use Your Content solely to provide and improve our Service
• This license ends when you delete Your Content from our Service

5.2 Our Intellectual Property

The Service itself, including its design, code, features, and trademarks, is owned by ImgOcean and protected by copyright, trademark, and other intellectual property laws.

5.3 Third-Party Rights

You agree not to upload any content that infringes the intellectual property rights of others. This includes but is not limited to:

• Copyrighted images, photographs, or artwork
• Trademarked logos or brand imagery
• Patented designs or inventions
• Content subject to licensing agreements

6. Content Storage and Deletion

6.1 Storage Limits

We may impose storage limits on accounts. Current limits are displayed in your account dashboard. We will notify you if you approach or exceed your storage limit.

6.2 Content Removal

We reserve the right to remove any content that:

• Violates these Terms
• Infringes copyright or other intellectual property rights
• Is reported by users and determined to be inappropriate
• Is required to be removed by law or legal process
• Violates our Acceptable Use Policy

6.3 Account Termination

We may suspend or terminate accounts that:

• Repeatedly violate these Terms
• Upload prohibited or copyrighted content
• Engage in abusive behavior
• Remain inactive for extended periods (with notice)

6.4 Data Retention After Deletion

Upon account deletion or content removal:

• Your Content will be deleted within 30 days from our active servers
• Cached copies may persist temporarily in backups for up to 90 days
• Publicly shared links will cease to function
• We are not obligated to retain copies after deletion

7. Service Availability

7.1 Service Changes

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service
• Change these Terms at any time (with notice)
• Implement usage limits or restrictions
• Update storage policies for guest and registered users

7.2 No Warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of content
• Warranties regarding the permanent storage of guest uploads

8. Limitation of Liability

To the maximum extent permitted by law:

8.1 No Liability for Damages

ImgOcean shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data
• Business interruption
• Loss of content or data (including automatic deletion of guest uploads)
• Damages resulting from copyright infringement by users

8.2 Maximum Liability

Our total liability to you for all claims shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.

8.3 Your Responsibility

You are solely responsible for:

• Your Content and its legality
• Maintaining backups of Your Content
• Compliance with applicable laws
• Ensuring you have rights to upload content
• Remembering guest upload deletion policies

9. Indemnification

You agree to indemnify and hold harmless ImgOcean, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any rights of third parties
• Copyright infringement claims related to Your Content

10. Third-Party Services

Our Service may contain links to third-party websites or integrate with third-party services (e.g., CloudFlare, Backblaze). We are not responsible for the content, privacy practices, or terms of service of these third parties.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. DMCA Compliance

We comply with the Digital Millennium Copyright Act (DMCA) and take copyright infringement seriously.

12.1 Reporting Copyright Infringement

12.4 Repeat Infringer Policy

We will terminate accounts of users who are repeat copyright infringers. Our policy is:

• First offense: Content removal and written warning
• Second offense: Temporary suspension (7-30 days)
• Third offense: Permanent account termination

13. Dispute Resolution
